Biden Administration's FISA Court Appointment Raises Serious Concerns

The Biden administration continues to raise serious red flags regarding its commitment to transparency and integrity within federal systems of oversight.

Recent news revealed that Jennifer Daskal, a prominent figure involved in the discredited Disinformation Governance Board, has been appointed as an advisor to the Foreign Intelligence Surveillance Court (FISA Court).

Daskal, who served as acting principal deputy general counsel at the Department of Homeland Security, is responsible for drafting the charter that enabled the controversial board's creation.


This Disinformation Governance Board was met with widespread criticism for its potential to stifle free speech under the guise of combating misinformation. Many lawmakers voiced their concerns that it improperly targeted dissenting voices on critical subjects ranging from election security to public health responses.

Senate Judiciary Committee Chairman Chuck Grassley expressed worries about Daskal's qualifications due to her previous role. He emphasized the need for a trustworthy selection process for individuals advising the FISA Court, especially in light of recent abuses of surveillance authority.

The concerns are not unfounded. Daskal had previously taken to social media to advocate for investigating President Trump for alleged obstruction during the Russia probe, while also showing support for controversial figures within the FBI, such as Andrew McCabe.

McCabe himself was embroiled in a scandal involving the use of the unfounded Steele dossier to gain surveillance warrants against individuals associated with the Trump campaign.

The FISA Court, now facing scrutiny for its past actions, has come under fire after revelations demonstrating a pattern of misconduct in the use of surveillance powers against American citizens, especially during the Trump administration.

The appointment of individuals with partisan ties to such influential roles raises persistent questions about the administration's commitment to upholding the rule of law and respecting the civil liberties of Americans.

Grassley is advocating for his FISA Accountability Act, which aims to enhance Congressional oversight in the selection of amici curiae for the court, ensuring that qualified and inherently neutral individuals provide unbiased legal guidance.

As the administration appoints more advisors deeply embedded in partisan controversies, the call for reform and accountability becomes even more critical in restoring public confidence in our surveillance systems.
