Conservatives brace for legal battle if Democrats attempt to remove Biden from ballot

An influential Republican group is preparing for a potential legal fight should Democrats attempt to remove President Joe Biden from the top of the ticket. The Heritage Foundation’s Oversight Project, led by Executive Director Mike Howell, has released a draft outlining their concerns and plans for such a scenario.

The group has identified three swing states where they believe taking Biden off the Democratic ticket would not allow anyone else to replace him: Georgia, Nevada, and Wisconsin. Wisconsin does not allow withdrawal from the ballot for any reason besides death, while Nevada prohibits changes to the ballot after a certain date or if a nominee dies or is adjudicated insane or mentally incompetent. In Georgia, if Biden were to withdraw less than 60 days before the election, his name would remain on the ballot but no votes would be counted.


The memo from the Heritage Oversight Project warns that policymakers and the public should be prepared for the potential consequences of Biden not running for re-election in 2024. The process for substitution and withdrawal presents many election integrity issues, and adherence to the law in some states may result in that process being unsuccessful for the purposes of another candidate being on the ballot.

Biden has publicly stated that he has no intentions of withdrawing from the race, but he has faced ongoing speculation about his cognitive decline. During his recent appearance at the G-7 economic summit in Italy, Biden was hardly seen in public and appeared tired and unfocused at times. Administration officials have pushed back on a clip of Biden appearing to wander off during a parachute demonstration.

Meanwhile, the Supreme Court is expected to rule on former President Donald Trump's presidential immunity claims early next week. Trump has been charged in a Washington, D.C., federal court with conspiring to overturn the 2020 election, but he has claimed that his actions were protected by presidential immunity. The high court will also need to rule on when companies can challenge federal rule-making and how states can regulate social media.

The upcoming rulings come after the Supreme Court ruled in favor of January 6 defendants who are charged with obstruction. The court is making it harder to charge defendants with obstruction, but those charges can still be brought if prosecutors can prove that rioters were intentionally trying to stop the arrival of certificates used to certify electoral votes during the riot.

The potential legal battle over Biden's place on the ballot and the Supreme Court's upcoming rulings on Trump's immunity claims and other issues are sure to be closely watched in the coming days and weeks. Conservatives are bracing for a fight and preparing to defend their interests in the face of potential challenges from Democrats.
