FLASHBACK: Harvey Weinstein Had Sexual Assault Case Buried By DA!

In 2015, Ambra Battaliana accused Harvey Weinstein of sexual assault, but the New York City DA in charge of the case declined to press charges due to lack of evidence.

Italian model Ambra Battilana, who hit the headlines in March when she accused movie mogul Harvey Weinstein of groping her at his New York City office, has resurfaced in Miami.

Battilana, who has attempted to keep a low profile since the Manhattan District Attorney's office announced it wouldn't be pursuing her claims, was pictured on Sunday with a mystery man keeping her company on the beach.

The former Miss Italy finalist looked simply stunning in a skimpy two-piece bikini as she enjoyed the good weather and took a dip in the warm waters.

The 22-year-old was forced to flee New York in the wake of the allegations after she became a target for the paparazzi, but on Sunday she looked like she didn't have a care in the world as she paraded along the sea front.

The model gained instant notoriety earlier this year when she went to the New York police with allegations that Hollywood heavyweight Weinstein had groped her breasts and put his hand up her skirt during a 'business meeting' at his Tribeca Film Center office.

Battilana claimed the 63-year-old father of five asked if her breasts were real before touching them.

The Manhattan DA's office investigated the Italian model's claim, but announced on April 10 that it would not be seeking to prosecute Weinstein.

'This case was taken seriously from the outset, with a thorough investigation conducted by our Sex Crimes Unit,' said DA spokeswoman Joan Vollero at the time.

'After analyzing the available evidence, including multiple interviews with both parties, a criminal charge is not supported.'

Weinstein, who always maintained his innocence, could have faced misdemeanor charges of forcible touching or sexual abuse if the allegations had proved true.

Battilana refused to cooperate with authorities for four days after lodging the complaint against Weinstein.

The delay led to speculation Battilana made the groping allegation up in a bid to try and land a part in one of Weinstein's films.

Once that 'pipe dream' came to nothing, she decided to cooperate and pursue the criminal case, according to sources.
