Biden sidesteps Supreme Court packing questions after Trump nominates Barrett

2020 Democratic presidential nominee Joe Biden skirted reporter questions regarding court packing in his first public comments after President Trump unveiled Judge Amy Coney Barrett as his third Supreme Court pick.

Biden, after a speech in Delaware on Sunday, told reporters he didn't want to address the issue of possibly expanding the country's highest court if Republicans forged ahead with replacing the late Supreme Court Justice Ruth Bader Ginsburg with Barrett and he won the Nov. 3 election in five weeks.

"We should see to it that the American public will vote in the Senate races in this election and they'll vote Republicans out of office. That's the consequence," he said.

Instead, the two-term vice president and 36-year Delaware senator insisted on linking Barrett's likely appointment to the Supreme Court as an assault on Obamacare and preexisting condition healthcare coverage. The court will once again consider the healthcare law's constitutionality in a case scheduled to be heard on Nov. 10.

"President Trump is trying to throw out the Affordable Care Act. He's been trying to do it for the last four years. The Republican Party has been trying to eliminate it for a decade," he said. "They see an opportunity to overturn the Affordable Care Act on their way out the door."
